What is a Civil Stalking Injunction?

A civil stalking injunction (CSI) is a document issued by the court to help protect you from someone who is stalking you. This is similar to a restraining order.

A Civil Stalking Injunction can help:

  • Set Limits. The document can require the stalker to stay away from you, your home, place of work, and/or homes of family members or relatives. It can also prevent the stalker from directly or indirectly contacting you by phone, e-mail, text message, etc.
  • Prevent Future Stalking. It can be a useful tool for ending current stalking and preventing the person from stalking you in the future.

How do I know if I qualify for a Civil Stalking Injuction?

CAPSA caseworkers can help you determine if you qualify for a civil stalking injunction.

Since stalking is legally defined as a behavior that has happened on two or more occasions, it is very important that a victim keep careful records and documentation of stalking behaviors. This documentation must be attached to the CSI.

How do I file a Civil Stalking Injunction?

Civil stalking injunctions must be filed with the court. CAPSA caseworkers offer assistance filling out these documents, and can be reached at 435-753-2500. Caseworkers are available from 9 a.m. to 5 p.m. Monday-Friday. A CAPSA caseworker can make sure you have all the supporting evidence needed to obtain the CSI, and that it is organized clearly.

To "file" the CSI, you must take it to the First District Court in Logan. Since the CSI must be filed with the court, it has to be filed during the hours that the court is open, which is generally between 9:00 a.m. and 5:00 p.m. weekdays (excluding holidays). They cannot be filed in the evenings, at night, or on the weekend.

NOTE: A civil stalking injunction is enforceable throughout the state of Utah. It will be entered into a statewide network and can be accessed by any law enforcement officer.

How much does it cost to file a Civil Stalking Injunction?

CAPSA caseworkers can help you fill out a CSI for free.

There is no fee to file a civil stalking injunction, and no fee to have it served to the respondent by the Sheriff's Department, if it is served within the state of Utah. For papers that need to be served outside of the state, the other state may charge a fee for the service.
